PURCHASE–SALE TERMS AND CONDITIONS

1. GENERAL PROVISIONS

1.1. These Purchase–Sale Terms and Conditions (the “Terms”) establish the conditions for purchasing goods in the online store www.tuning.com (the “Store”), as well as the rights, obligations and responsibilities of the Buyer and the Seller.

1.3. The Buyer is a natural or legal person who purchases goods from the Store.

1.4. By placing an order in the Store, the Buyer confirms that they have read and agree to these Terms.

1.5. The Seller has the right to amend these Terms. However, the version of the Terms applicable to the Buyer shall be the version in force at the time the order was placed.


2. CONCLUSION OF THE PURCHASE–SALE CONTRACT

2.1. The purchase–sale contract between the Buyer and the Seller shall be deemed concluded when the Buyer places an order in the Store, provides the required information, selects a payment method and makes payment or selects another payment method offered by the Store, and the Seller confirms the order.

2.2. When placing an order, the Buyer must provide accurate and complete information necessary to fulfil the order and deliver the goods.

2.3. Order confirmation shall be sent to the email address provided by the Buyer when placing the order.

2.4. If, for objective reasons, the Seller is unable to fulfil an order, the Seller shall promptly inform the Buyer and refund any amounts paid by the Buyer, where applicable.


3. RIGHTS AND OBLIGATIONS OF THE BUYER AND SELLER

3.1. Buyer's rights

The Buyer has the right to:

3.1.1. purchase goods offered in the Store;

3.1.2. receive information about the characteristics, prices, delivery conditions and other information required by law;

3.1.3. withdraw from a distance contract in accordance with applicable law;

3.1.4. return defective goods or exercise other remedies provided by law;

3.1.5. contact the Seller regarding an order, product, delivery or other matters related to the purchase.

3.2. Buyer's obligations

The Buyer undertakes to:

3.2.1. provide accurate information;

3.2.2. pay for the ordered goods on time;

3.2.3. accept the ordered goods;

3.2.4. before using a product, ensure that it is suitable for the particular vehicle and intended use, where applicable;

3.2.5. properly use and install the goods in accordance with the manufacturer's, Seller's or installation instructions, where provided.

3.3. Seller's rights

The Seller has the right to:

3.3.1. refuse to fulfil an order if the Buyer has provided incorrect information or if, for objective reasons, the order cannot be fulfilled;

3.3.2. require the Buyer to properly fulfil their obligations;

3.3.3. change the range of goods offered in the Store, prices and other commercial conditions, except for conditions applicable to contracts already concluded.

3.4. Seller's obligations

The Seller undertakes to:

3.4.1. provide the Buyer with the ordered goods in accordance with the order conditions;

3.4.2. provide the Buyer with information required by law;

3.4.3. ensure that the goods sold comply with applicable quality and safety requirements;

3.4.4. process Buyer's requests, complaints and returns in accordance with applicable law.


4. PRODUCT PRICES AND PAYMENT

4.1. Product prices in the Store are indicated in euros (€), including applicable VAT, unless otherwise provided by law.

4.2. The final order amount, including delivery costs, shall be displayed to the Buyer before the order is placed.

4.3. The Buyer may pay using the payment methods offered in the Store.

4.4. The Store may offer the following payment methods:

  • bank transfer;

  • payment card (Visa, Mastercard or another payment card specified in the Store);

  • other payment methods indicated in the Store at the time of placing the order.

4.5. Payment card details are not stored by the Seller where payment is processed through an external payment service provider.


5. DELIVERY OF GOODS

5.1. Goods shall be delivered to the address specified by the Buyer in the order or using another delivery method selected by the Buyer.

5.2. Available delivery methods, delivery times and delivery costs are indicated in the Store when placing the order.

5.3. The delivery period depends on the selected delivery method, product availability and the delivery period indicated to the Buyer at the time of ordering.

5.4. The Seller shall not be liable for delivery delays caused by circumstances beyond the Seller's reasonable control or by the actions or omissions of third-party delivery service providers. However, the Seller shall take reasonable steps to resolve the situation.

5.5. Upon receiving the shipment, the Buyer should inspect its condition. If visible damage to the shipment or goods is identified, the Buyer should promptly inform the Seller and, where possible, document the damage with photographs.


6. RIGHT OF WITHDRAWAL AND ORDER CANCELLATION

6.1. A consumer who has concluded a distance contract has the right to withdraw from the contract without giving a reason within 14 days, except where an exception provided by law applies.

6.2. The 14-day period begins on the day on which the Consumer, or a person designated by the Consumer other than the carrier, receives the goods.

6.3. If several goods are ordered in one order and delivered separately, the 14-day period begins on the day on which the last product is received.

6.4. To exercise the right of withdrawal, the Buyer must clearly inform the Seller of their decision to withdraw from the contract by contacting:

6.5. The Buyer may submit a free-form withdrawal statement or use the model withdrawal form provided by applicable law.

6.6. After withdrawing from the contract, the Buyer must return the goods without undue delay and no later than 14 days from the date on which the Buyer notified the Seller of the withdrawal.

6.7. The Buyer is responsible for any decrease in the value of the goods resulting from handling the goods beyond what is necessary to establish their nature, characteristics and functionality.


7. RETURN OF GOODS

7.1. Returned goods must be properly packaged to prevent damage during transportation.

7.2. Goods must be returned to:

7.3. The Buyer should return the goods using a delivery method that allows the shipment and its delivery to the Seller to be verified.

7.4. The Buyer shall bear the direct costs of returning the goods, except where applicable law provides otherwise or the Seller voluntarily agrees to reimburse such costs.

7.5. If a defective or incorrect product is returned, the issue of return delivery costs shall be handled in accordance with applicable law.


8. WHEN GOODS MAY OR MAY NOT BE RETURNED

8.1. A Consumer may return goods within 14 days of receiving them, unless an exception established by law applies.

8.2. Returning goods because the Buyer has changed their mind does not prevent the Buyer from examining the goods to the extent necessary to establish their nature, characteristics and functionality. However, the Buyer is responsible for any decrease in the value of the goods resulting from handling beyond what is necessary for such examination.

8.3. The right of withdrawal does not apply where, under applicable law, such right is excluded, including goods manufactured according to the Buyer's specific instructions or clearly personalised for the Buyer, where such statutory exception applies in the particular case.

8.4. The right of withdrawal may also be excluded in other cases established by applicable law.

8.5. Goods cannot be considered non-returnable solely because their original packaging has been opened, where the Buyer has a statutory right of withdrawal.

8.6. Defective goods may be returned even after the expiry of the 14-day withdrawal period where a defect is identified and the Buyer exercises the remedies provided by law.


9. PRODUCT QUALITY AND WARRANTY

9.1. The Seller guarantees that goods sold to consumers comply with the quality, safety and conformity requirements established by applicable law.

9.2. Consumers have the rights provided by applicable law in relation to defects and non-conformity of goods.

9.3. If a product defect is identified, the Buyer should contact the Seller by email at [email protected], indicating the order number, product name and the identified problem. Where possible, photographs or video showing the defect should be provided.

9.4. Upon receiving the Buyer's request, the Seller shall assess the situation and offer a solution provided by applicable law.

9.5. Automotive parts must be installed according to their intended purpose and, where necessary, by a qualified professional. The Seller shall not be liable for damage resulting from improper installation, use or modification of a product, to the extent permitted by applicable law.

9.6. The Buyer is responsible for ensuring that the selected product is suitable for their vehicle where compatibility depends on the specific vehicle version, equipment, model year or other technical parameters.


10. REFUND OF PAYMENTS

10.1. Where the Buyer lawfully withdraws from the contract, the Seller shall refund all payments received from the Buyer, including standard delivery costs, except where otherwise provided by applicable law.

10.2. The Seller shall refund the money using the same payment method used by the Buyer for the original transaction, unless the Buyer expressly agrees to another method.

10.3. The Seller may withhold the refund until the goods have been returned or the Buyer has provided evidence that the goods have been sent back, whichever occurs earlier.

10.4. The refund shall be made without undue delay and no later than 14 days from the date on which the Seller receives the Buyer's withdrawal notice, subject to the exception set out in Clause 10.3.

10.5. If the Buyer selected a more expensive delivery method than the standard delivery method offered by the Seller, the additional delivery costs shall not be refunded, to the extent permitted by applicable law.


11. DISPUTE RESOLUTION

11.1. If the Buyer believes that the Seller has violated the Buyer's rights or legitimate interests, the Buyer should first contact the Seller in writing at [email protected], stating the claim and relevant circumstances.

11.2. The Seller shall examine the Buyer's complaint and provide a response within the time limits established by applicable law.

11.3. If the dispute cannot be resolved amicably, the Consumer has the right to contact the competent consumer dispute resolution authority or court in accordance with applicable law.

11.4. Consumers may also use alternative dispute resolution mechanisms provided for under European Union law, where applicable in the particular case.


12. FINAL PROVISIONS

12.1. These Terms shall be governed by the laws of the Republic of Lithuania, taking into account mandatory consumer protection provisions applicable to consumers under the laws of their country of residence where required by European Union law.

12.2. If any provision of these Terms is declared invalid, this shall not affect the validity of the remaining provisions.

12.3. These Terms shall apply from the date on which they are published in the Store.
